Involved Parties

Optimus CarRental provides “THE CLIENT” the following services:

Negotiation of optimal car rental conditions from car rental service providers, and providing such services directly to the final users;
Submission of reservation to the car rental provider on behalf of the client and confirmation of the same;
A reservation fee is charged for reservations that have been confirmed by the car rental provider.

The car rental provider (the “CAR RENTAL COMPANY”) provides:

Car rental services from their own car fleet. Rental contract is signed directly with the car rental company;
The balance of the car rental price is paid directly to the car rental company upon pick-up of the car;
Car rental price includes the rental of the vehicle and services/taxes/charges that are specifically stated in the rental terms and conditions for every each car rental provider. Additional equipment (extras) are subject to approval and additional cost.

Time and Date Terms

CAR RENTAL START – date and time of a car pickup as specified on the voucher;
RESERVATION TIME – the date and time of a reservation payment;
LATEST CANCELLATION – 48 hours prior to the CAR RENTAL START
LATEST RESERVATION CHANGE – 72 hours prior to the CAR RENTAL START

Reservation Cancellation

In case of cancellation, according the car rental provider’s cancellation policy, additional charges may arise;
If the client does not possess a cancellation protection, Optimus CarRental will not refund payments made for car rental booking services it has provided. Explanation of Cancellation Protection follows: Cancellation Protection
At the time the reservation is made, the client is offered to chose and buy an optional cancellation protection which gives him a possibility to cancel the subject reservation. Cancellation protection is only valid and can be used at least 48 hours before the car rental start (before the LATEST CANCELLATION date and time)
Booking cancellations are only accepted if placed through the Optimus CarRental Website. Booking cancellation through direct contact with the car rental company is not allowed;
The client loses the right for reimbursement in case of:
- early end of car rental;
- delay for car pick-up according the appointed hour and/or date;
- no show up and failure to pick-up the car, or
- reservation is cancelled within 48 hours before the car rental start.

Reservation Change

Reservation details can be changed if amendment request is placed through the Optimus Carrental Website and if it is placed at least 72 hours before the car rental start (before the LATEST RESERVATION CHANGE date and time)

Changes to the reservation may incur additional costs on the client's behalf;
A new voucher with changed rental details will be issued to the final client;
No refund is made in case of changes to the reservation even if the new down payment is lower than the original one;
In case the changes of the reservation result in a higher down payment amount than the original one, the client must pay the difference between the original and the new down payment amount.

Refund Policy

Refund of the payment is only possible for clients holding cancellation protection. Refund is possible only if the reservation cancellation is placed at least 48 hours prior to the CAR RENTAL START.

Non-refundable items:

Refunds will not be issued to clients who break any of the Terms and Conditions;
Administration fee is non-refundable;
Cancellation protection fee is non-refundable.

Full refund (including otherwise non-refundable items) will be given when the reservation is cancelled by Optimus CarRental.

Car Rental Documentation

An Order Confirmation is sent to the client after the car rental reservation is placed and the down payment is paid. After the car rental provider confirms the availability of subject car, Optimus CarRental shall deliver to the client an e-copy of the voucher with all car rental details and reservation number. The client must present a passport and a copy of the voucher to the car rental company upon pick-up. Optimus CarRental cannot be held accountable for failure to rent or pick-up the car if a copy of the voucher and passport is not presented during the pick-up attempt. A copy of the voucher can be retrieved from Optimus CarRental Web site with reservation number and e-mail address.

Car Rental Services Payment

Payment for car rental booking services provided by Optimus CarRental are only available if made by Visa or MasterCard/EuroCard;

Optimus CarRental endeavors to ensure that all credit card and debit card transactions on this booking engine are secure. HOWEVER, if unauthorized charges appear on your credit card or debit card statement for any card used on this booking engine at any time during or after you make your reservation, conduct your transaction or disclose your card details on this booking engine, Optimus CarRental shall not be liable or responsible in any way in respect of any damage or loss of whatsoever nature suffered by you arising from or in any way connected with said use, transaction or disclosure, subject only to any statutory rights which you may have. Please note this booking engine is Verified by Visa and holds MasterCard Secure code.

All prices at Optimus CarRental are presented in EUR with corresponding values in USD and GBP which are only for informative reasons because discrepancies might occur due to daily changes in their FX rates. Online payment for car rental services provided by Optimus CarRental or potential refund of payment will be authorized and settled in MKD (Macedonian Denar) in appropriate foreign exchange rate of 60,50 MKD per EUR. Optimus CarRental settles its bills in MKD due to technical advantages provided by the Macedonian online payment processing centers.

The Customer agrees that the final settlement of his credit card payment for the certain reservation can be executed on a date different from the date the reservation has been done. The date of settlement will be decided by the Optimus CarRental on its sole discretion.

The balance payable on pick-up is paid directly to the car rental company upon pick-up, according the payment policies of each car rental company which is communicated to the client on the voucher sent by Optimus CarRental;

Reservation Rejection

Car rental companies reserve the right to reject reservation of car rental to any customer they believe is not fit to drive or fails to meet the required conditions. In such a case, Optimus CarRental does not accept any liability to the client and the client is not eligible for refund of the costs of reservation.

Vehicles subject to Car Rental

All pictures of the cars presented on the Optimus CarRental Web site serve to provide the client a general view of the car and may change without prior notice;
Car rental companies reserve the right to change the car model due to availability, but always will provide a car from the same car category as the one originaly booked. Any claim by the client to the specific model, producer, type or color shall not be considered;
Optimus CarRental does not accept any liability if the rented car is not suitable to carry the desired number of passengers and their luggage.

Optimus CarRental Liability

Information provided by Optimus CarRental is provided by individual car rental companies and is subject to change without prior notice. Optimus CarRental cannot be held accountable for any changes beyond our control;
In the event of a dispute between Optimus CarRental and you, our liability to you, if any, is limited to the amount of our processing fee you paid when booking the vehicle;
Except to the extent contrary to law, neither Optimus CarRental nor any of our directors, owners, employees, affiliates, travel partners or other representatives will be liable for any direct or indirect loss or damages arising out of, or in connection with your use of any information, products, services and/or the materials offered through this booking engine, including but not limited to loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, or any indirect or consequential loss or damages howsoever arising, even if Optimus CarRental has been advised of the possibility of such loss or damage or such loss or damages were reasonably foreseeable;
In case of problems, questions, concerns, complaints or other issues during the actual period of rental, the client must directly contact the contracting car rental company.

Relations: Car Rental Company – Client

Upon pick-up of the rented car, the client must sign a rental contract with the car rental company. It is client’s responsible to make sure the contract details are matching the rental details provided by Optimus CarRental voucher;
Upon signing of the car rental contract, the client is liable to pay the balance rental amount, any additional payments paid locally and leave guarantee in a form of deposit according the car rental company terms and conditions.

Pricing

Optimus CarRental makes every effort to ensure that prices quoted at the time a booking is made on this booking engine are accurate in all material respects. Nonetheless Optimus CarRental reserves the right to amend the price quoted at the time a booking is made in the event of a manifest or patent error in the price quoted. Optimus CarRental will endeavor to notify the customer as soon as reasonably practicable in the event that a price quoted at the time of booking is incorrect. In the event of a change of price quoted at the time of booking the customer may elect to pay the amended price or alternatively the customer will be entitled to a refund of all sums paid. The foreign exchange rates used by Optimus CarRental to display prices in the currency chosen by the consumer are updated frequently. Foreign exchanges rates used by your credit card company may vary. Optimus CarRental cannot be held responsible for any discrepancy between the price displayed by Optimus CarRental and the amount charged by your credit card company due to the rate of exchange used.

Service Access

While Optimus CarRental endeavors to ensure that the booking engine is normally available 24 hours a day, Optimus CarRental shall not be liable if for any reason the booking engine is unavailable at any time or for any period. Access to the booking engine may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond Optimus CarRental’s control. Optimus CarRental reserves the right to make alterations to the booking engine at any time.

Copyright, Notice and Limited License

All of the information within this booking engine including but not exclusive to, content, text, graphics, images, trade names, structure, photographs, buttons, artwork, computer code are protected by copyright, various intellectual property laws and laws under international treaties, and is only available to you for personal purposes. Unless you have received written consent from Optimus CarRental to the contrary, you may only use the booking engine and its content for personal, non-commercial purposes. You do not have permission to modify, copy, distribute, collate, transfer, reproduce or display any of the above for personal or business use. In particular, by proceeding to access this booking engine, you agree:

Not to use the booking engine to make any speculative or false reservation;
Not to use the booking engine to research suppliers or suppliers pricing;
Not to use the name "Optimus CarRental" or any Optimus CarRental branding for commercial purposes without obtaining prior written permission from Optimus CarRental; and
Not to reproduce material from this booking engine (Website) for commercial purposes.

Other General Terms and Conditions

All car rental bookings are subject to this user agreement and the making of bookings via Optimus CarRental is acknowledged by you as being bound by such agreement.
No other terms, conditions or warranties, expressed or implied by law, custom or dealing with us shall form any part of any contract between us and you unless specifically made in writing by us addressed to you.
The terms and conditions of this user agreement shall be deemed to be modified and/or varied by any provision of any legislation or regulation which negates or modifies any provision of this agreement.
You acknowledge that in making a booking with Optimus CarRental, you do so on the basis of the material contained on the site and subject to this agreement and you acknowledge that any statement or representation by Optimus CarRental, its employees or agents have not been relied upon other than as may be specifically set out on our site.
The rental of any vehicle will be subject to the law of the country in which it is supplied to you.
You should satisfy yourself that you understand and agree to the terms of a rental contract entered into and you should be aware that you will be subject to and must comply with the terms of such agreement and with the law as applicable at such place from time to time.
We do not except liability for any charges incurred by you with your authority or otherwise.
We reserve the right to levy any government increase in local taxes that may be introduced after the publication of this site, however, we will make every effort to ensure that you are notified of any of these matters either prior to your booking or as soon as practicable after we have knowledge of such increases.
Any additional charges payable upon arrival by you at the time of collection of the vehicle are subject to local taxes at the prevailing rate from time to time in that country.
Apart from any conditions contained in any rental agreement with the car rental supplier you will be held responsible for anyone driving under the influence of alcohol or drugs, causing willful damage, driving off road, or driving negligently and/or without due care or attention or in breach of any road laws and you agree to indemnify Optimus CarRental against any claim or demand whatsoever in respect to any breach of this condition.
There may be restrictions as to the availability of vehicles at peak times.
All cars and all offers are subject to availability and all information including prices is correct, to the best of our knowledge, at the time of publication.
You may have certain statutory and legal rights as a consumer and the terms and conditions of the user agreement are to be read subject to such rights.
Optimus CarRental may revise these Terms and Conditions at any time by updating this posting.
